MOSGEIL COURT
The following cases were dealt with at Mosgiel Court yesterday, before Mr J. R. Bartholomew, S.M.: — MOTOR COLLISION. Walter Grieve Beattie, a farmer, of Maungatua, claimed from Andrew Miller Finnic, a bus driver, of Berwick, the sura of £2l 9s 6d. The action arose out of a collision between Beattie s car and Finnie’s bus at the intersection of a side road and the Oiit'ramBerwick road on February 21. The claim represented the amount of damages caused to the car as a result of the alleged negligence of the driver of the bus (Edward M'Kenzie Grant). The defendant counter-claimed for the sum of £2B 13s damages to the bus, caused, it was alleged, because the driver of the car, James C. Beattie, failed to give way to traffic on the ri<dit. Sir J. C. Robertson appeared for the plaintiff and Mr E. J. Anderson for the defendant. After hearing the evidence, the Magistrate ruled that the plaintiff was not entitled to recover, and also nonsuited the defendant bn the counterclaim. Solicitor’s fee (£3 3s) was allowed to defendant (Finnic), and the same amount was allowed Beattie, in the counter-claim. WANDERING STOCK. James Stuart Dickson was fined 20s and costs for allowing stock to wander on the Main highway. AN ADVERTISING CLAIM. W. J. Crawford, of Palmerston North, sought to recover the sum of 37s for advertising in exercise books from P. J. Cooper, Mosgiel. Mr C. J. Robertson represented the plaintiff and Mr B. A. Quelch the defendant. After hearing the statements of the solicitors in the case the Magistrate non-suited the planitiff.
