CANCER BEQUEST
COURT RULING ON DISPOSITION [Pea United Phess Association.] WELLINGTON', June 15. The Supreme Court has decided that the Public Trustee may pay in such shares as be thinks fit a legacy of £lO.000 among all or any organisations in London having as their object the investigation of the problems of cancer. The judgment of Mr Justice Heed was given to that end, following an originating summons by the Public Trustee against the trustees of the Imperial cancer research fund and the .British Empire cancer campaign. Under the will of the late Emily Lilias Johnston, of Wellington, £IO,OOO. was bequeathed “ to persons in whom is vested the Imperial cancer research fund in London for the general purposes of the said fund, and I direct that r if there is more than one such fund my trustee shall pay the said sum to such one or more of such funds in such shares as he thinks fit.”
The trustee sought the court’s interpretation in answer to a question: “ Whether the Imperial cancer research fund was solely entitled to the £lO,000.” Afr Justice Reed answered the question as follows ;—The defendants are not solely entitled to the legacy of £IO,OOO, and the plaintiff may apportion and pay such legacy in such shares as he thinks fit to and among all or any organisations that exist in London, having as their object investigations of the problem of cancer.
