FORMAL MARRIAGE AND DIVORCE IS IT LEGAL? [Pm Uhiteo Press Association] WELLINGTON, June 14. Two persons agreed to marry, to separate lor ever, and eventually to he divorced. Is such a transaction lawful? In English law the pact is void, as being against public policy. In New Zealand it may be different, and the Appeal Court is to decide. The case is one which came before the Chief Justice (Sir Michael Myers) some ■weeks ago in the form of a divorce petition of the parties who were married in Auckland and separated under a prenuptial agreement. The wife stated at the time that the man was her husband, and she could Jive with him, for she was advised that the agreement was not binding. However, the parties could not agree on the matter and remained apart. The cost of the appeal will bo on the Crown.
