V\e invite the attention of the Southern Juburban United Councils to a legal question involved in the construction of tramways through Kensington and South Dunedm which they may possibly have already considered, but if not, ought to be duly weighed before any deo'sive step is taken. I he Councils appear to be relying upon the Tramways Act of 1872, which gives ample peweta to Borough Councils either to construct tramways on their own account, or to enter into contracts with tramway companies. The 298 th section of the Municipal Corporations Act, 1876, however, repeals all the sections of the Tramways Act empowering Councils to buy or construct tramways, but seems to leave the power of nogotiatine with promoters untouched, although the precise effect of the repealing clause upon the latter authority could only be determined by a trained lawyer. The suburban Councils contemplate granting a concession; but obviously, extreme care will require to be shown in framing the agreement between the Corporations and the promoters, lest the former should overstep their authority, and so get into difficulties.
