ALLEGED PERJURY.

Mr Bathgate, R.M., was occupied the whole of to-day, from half-paet eleven in the morning, m hearing the complaint of Henry Smythies, which is—that Captain J. U Russell committed perjury in the affidavit he made on June 12, 1808, in connection with the case of Russell v. Barton, then proceeding in the Supreme Court. Mr Denmston appeared for the complainant, and Mr'Macassey, instructed by Messrs Howorth and Hodgkins, for the accused. A great deal, of time was occupied in the examination of, Mr Registrar Ward, who produced a heap of documents. Mr Smythies was under examination during the rest of the day, his evidence in chief terminating shortly' after' four o'clock. The further nearing Of the case was then adjourned till Wednesday next. *■<
