Mr Macasßey, with him Mr Stewart, appeared for the plaintiff; Mr Haijgitt, with him Mr Stout, for defendants. This oase was continued this morning, further evidence being given for plaintiff.

Andrew M'Kinnon, shipbuilder at Port Chalmers, deposed as to repairs he had effected to the Cssaarewith. He believed her to be seaworthy, and had never heard of her seamen complaining of her being unfit to go to s«a. Biohard Sinclair, raaster.mariner. stated that in his opinion the barque was strongly built and auite seaworthy. - Mr Haggitt said he had a number of ether wit. nesses as to the ship's seaworthiness, but their evidence would be a mere repetition of what had already been given and he would therefore net call them.

After addresses by counsel, PHIIII •His Honor summed up at some length. Hesaia the main tone for the consideration of the jury was whether the Ceuarewiteh was seaworthy at the timeßhe left the Bluff Harbor. The Jury retired at 1.86 p.m. and returred into Court after ten minutes' deliberation finding for the paintiff on all the issues, and assessing the damages at the amount claimed.
