At the Resident Magistrate’s Court, Port Chalmers, this morning, Mr T, A. Mansford delivered judgment in the cases brought by Cotter and Meilley v. Gibb, for assaults. His Worship said that, although masters of ships possessed considerable power over seamen on the high seas, yet those powers must not be arbitrarily used ; discretion and forbearance should bo exercised. He considered the conduct of the captain, particularly in the case of Mailley, to have been cruel and inhuman, and for it h.e could not inflict an adequate punishment without indeed committing him for trial, which would necessarily detain bis officers and crew and possibly the ship till the next sitting of the Supreme Court. He would therefore treat both cases as common assaults. In Cotter’s case he would fine the defendant L 5 and costs or fourteen days’ imprisanment; and in the case of Meiley L 7 and costs or twenty-one days’ imprisonment with hard labor.
