Monday, August 21. (Before A. C. Begg, Esq., and J. Logan, Esq., J.P.'s). Drunkenness.—John Miller, Andrew fUulstou, Margaret Smith, Thomas Harvey, and William Campbell were all fined ss, in default twenty-four hours' imprisonment; Joseph Carey, Theophilus Ray, and John Dunoghue, 10s or forty-eight hours; Henry Ayers, 2G?, or four days; William Todd, 203, or three days ; Ellen Maitland, L 5, or fourteen days. Assault with a Tomahawk.—George Brereton, a young man, was charged with assaulting and beating James Keyß on the 20th inßt. Inspector Mallard said that this was an instance of one of those disgraceful scenes occurring in brothels. If the Bench considered the case preved, he asked them not to inflict a fine, but to send prisoner to gaol as a warning to others.—Prosecutor, a laborer, said he went into a house in Machin's right-of-way yesterday afternoon. Prisoner endeavored to eject him, and a struggle ensued. When prisoner got him outside he struck him with the tomahawk produced. Witness had had been to the Hospital to get the wounds dressed.—Mary Anne Ford witnessed the disturbance. While in the house prisoner attempted to strike Keys,, but was prevented by the prosecutor holding his arm. Witness afterwards saw prisoner in the yard washing the axe.—Charlotte Frederick saw prisoner washing the axe, and afterwards throwing into the next yard.—For the defence, David Constance was called, but he failed to prove anything. In cross-examination, witness said that prisoner and three women lived in the house besides himself. He did not know how the women got their living; he believed men co- habited with them. The house belonged to Mr Pavletich, and witness collected the rent. thought it was quite plain why Mr Pavletich had petitioned the Government to bring the Contagious Diseases Act in force.—Walter Deacon, who also lives in the house denied that prosecutor had been struck by prisoner with a tomahawk.—The Bench considered the case fully proved. It could not be tolerated that any man should use an instrument like that produced. They would pass a heavy sentence under the circumstances,, Prisoner was sentenced to two months' imprisonment. Alleged Larceny.—Christopher Hannah was jpharged by Andrew Grainger, ceal merchant, with stealing, in May last, one box, one milk-can, and other goods, the whole of the value of 10s. Mr Mouat appeared for prosecutor j Mr Joyce defended. —The parties were neighbors at South Dunedin, and most of the goods said to have been stolen were found io. the yard jointly occupied by them. —The Bench considered the oasa a paltry affair, and without calling on tbo defence dismissed the charge, holding thivb it should never have been brought into Court. *
