RESIDENT MAGISTRATE'S COURT.

Fjridat, Jult 14. Bathgatt, £sq., 8.M.) J. Martin y. Collins (of Wellington).— His Worship stated that no return had been nude in tue case. The summons was sent to Wellington on June 22, but no answer had been received on the 30th, and the case was adjourned for a fortnight. A letter was written to Wellington asking for an explanation, but no answer had been received. Under those circumstances a further adjournment would be necessary, and the clerk of the Court would telegraph to Wellington to ascertain the cause. Sampson v. Penman.—This was a fraud summons, brought by plaintiff, a coal merchant, for coals sold.—Defendant stated that he had been unable through misfortune to pay the amount. Since judgment had been given against him his horse had died, and he had not been in work.—Plaintiff said that he had a conversation with defendant on Friday, when the latter said his book debts were LSO, and that he had a horse and harness in his possession.—Defendant stated that he was insolvent, and that he had declined to give plaintiff his book debts to the prejudice of other creditors.—His Worship held that it was not a case for a judgment summons, and dismissed the case.
