B; Bartoh Wtta. in support, and Mr Stout for the gaeler contra, of an application, calling upon theGovernor the gaol 'to show cause -why Em ily Zirk, no w -detMned there <on -a bhm-ge ‘ of having stolen,an antimacassar frobrthe Globe Hotel; should not be dischargedflbhi custody, on the grounds that the arrest - was illegal,: that the committing magistrates had exceeded their duty, and that the warrant of commitment was bad. tTndCr this latter head Mr Barton contended that there was an informality in the warrant j being addressed to the VChief Constable” of Dunedin, when no such officer existed; butrhtir Honor ruled that that was an allegation 5f T a fact which should have been set out ih'the' affidavit, but not having* been so he dd dined to allow the point to be argued. The point chiefly relied upon was that the search warrant being directed to ‘* one ’’ waß"udt. sufficiently specific. His Honor intiinated his intention of delivering his decision-on Friday morning.
