THE LEITH STREET ASSAULT CASE.
At 5 p m. the Bench delivered the following decision:—“ In the opinion of the Bench the case is one which ought to have been dealt with summarily but as it would appear that any of Her Majesty’s subjects have the right to demand trial by the Queen’s Bench in cases of assault, and as the assault has been proved, although evidently without felonious intent, and as the evidence is somewhat conflicting, the Bench have decided that it will be more in accorr’ance with the usual- course adopted in these cases to send the same for trial.”— —Mr Barton: Under these circumstances it amounts really to an acquittal so for as this Court is concerned, and that Thomas ought not to be put under arrest.—Bail was fixed, Thomas inL2O and two sureties of LlO each.
