RESIDENT MAGISTRATE'S COURT.
Thursday, April 20. (Before J. Bathgate, £<q.. R.M.) Bethune v. Lament was adjourned for a week on payment of costs of the day. Thomas Harrison v. Edward Crfcroy.— Claim of L2 18s Id, tolls from 13th July to 29th March. Mr Bathgate defended.—The evidence showed that plaintiff hnd no authority to sue, and he was accordingly non-suited, with costs.
John Paisley v. Wm. Cooper (Mosgiel).— Claim L 5, price of a chesnut horse and 1 , loan of saddle. Mr Bathgate for plaintiff, Mr Harris, jun., for defendant. Judgment for plaintiff for L 4 with costs. Daniel Bethune v. Benfell. —Claim U3 7s 9d, for meat supplied. Mr Bathgate for plaintiff, Mr Cook for defendant, who put in a set-off of Ll3 7s 9d, for bricks delivered. Judgment for the amount claimed, the setoff being disallowed till the contract for supplying the bricks was completed. Kong Sing Wing v. Samuel Vincent.— Plaintiff, a merchant, sought to recover from defendant, master of the ship Gloucester, L 72 Os Bd, damage to merchandise before landing. Mr Bathgate appeared for plaintiff ; Mr Haggitt defended. [Lefc sitting.]
