THE BEAUMONT COACH ACCIDENT.
At ihe sitting of the District Coart at Lair, fence on Monday, before Justice Harvey and a jury, Darnel Anderson, of Bellamy station near OMapeka, manager, and Agnes, his wife, sued Job Wain and John Chaplin, both of jjunedip, coach proprietors, for damages bob. tamtu by the plaintiff Agnes Anderson, wife of the said Daniel An lereon, by reason of the negligence of the defendants m respect of the following matters set forth in plaintiff’s declaraTluit on 4th of 1874, William Duff, the servant of defendants, unskilfully and recklMsly drove the coach which was overturn d, whereby plaintiff was thrown out and was wounded, and became permanently disThat said coach was not provided with a break. (3.) That the horses were not ffww “dipped with breechmg. and (4.) that the coach was overloaded. That Duff was not the rervant of defendants jointly, but the servant of the defendant, Chaplin. That the overturning of the coach was an accident or misfortune, and was not caused by any negligence on the part of the defendants ot their servants.. Messrs Taylor (Tokomairiro) ar.d Gooday appeased for plamt'ffs, and Mr B. C. Hagvitt for defendants After about an hour’s absence the ju>y (by direction) returned a verdict for the defendant Wain, and oa the first two allegations in the declaration for the plaintiffs as airainst the defendant Ch»pln: the damans < befog assessed at L 125 and costs.
