BREACH OF PROMISE CASE BY A MAN SEVENTY YEARS OF AGE.
AGE. » Evidence was given at a Court in Victoria lately, in an action brought by James Miller, commissary officer. Forrss, against Miss Miller, of Nairn, for damages for breach, of promise of marriage. Plaintiff, who is in his 70th year, and defendant, who is between 40 and 50, were the only witnesses examined. Plaintiff deposed that he met the defendant in a railway carriage in the month of January last year, and he went to get a foot-warmer for her, and that he fell in love with her. He wrote, asking* for an interview, and said, "My love for you cannot be restrained. It has mastered me, and I must obey its impulse. Fulfil, then, my dear madam, the hope that I have been fondly dreaming over, and convert into a reaUty the sweet idea that has overpowered me." He had the desired interview in March. "We had," he said,, "a long conversation! bhe promised to marry me. She was sitting on my knee. We had some wine together She offered me a glass. We both drank out' of the glass at the same time.—(Laughter ) I kissed her; she was all life! and fun Z (Laughter.) After that she tookmeinto every room and bedroom in the house. I gave her a ring, and took a note of every word that passed between us. At a subsequent interview she said she would take nobody but me. The ring she chose had the word Dearest'upon it?' Miss Miller was then examined. She denied the promise, and said she would not marry plaintiff iiLhe had LIOO.OOO.
