CITY POLICE COURT.
Monday, February 7. V. Pyke, Esq., D.M., and G. M'Leari, Esq., J.P.) Drunkenness.—foemy Ayers, Mary Upjohn, Donald Boss, and Susan Thomhs, alias Milly Crawford, and John Gray, for being drunk on Sunday, were each fined 10.*, in default three days’ imprisonment; Wm. Williams, alias Jardine, was fined ss, or twentyfour hours’ imprisonment. Diehard Miles, for being drunk while in charge of a donkey, was fined 40s, or fourteen days’ imprisonment; apd for being an habitual drunkard to an additional month’s imprisonment. Miles: I aint had a month, air, fora long time. Assault,— The prisoner Gray was further fined 20s, in default a week’s imprisonment, for assaulting Mary Anne Suttor. Theet. Albert Smith was charged with stealing a saw, a brush, and a lantern, of the value of 20s, the property of Diehard Drive'*, carpenter, Brokoairi.—Evidence was given by George Latimer, who deposed that the goods were pawned at Isaac and Marks’s pawnship by accused; and by Thomas Pavletich, who deposed to the goods, being left at his house, from where they had been stolen, by prosecutor, after which the case was adjourned till Wednesday for the production of prosecutor.
Excessive Toll Payment.— George Hedley, tollkeeper at the Water of Leith, was charged by John Lumsdsn Jopp, with demanding ex cessive t >ll on February 1, Mr Adams appeared for complainant. Mr Stewart defended. —Complainmt had driven a waggon and eight horses through the toll-bar. Two horses were also yoked to the waggon. Comp’.ainat offered 9s toll—a shi’ling for each horse drawing the carl - , and sixpence for each of the two yoked to it—but the toll-keeper demanded eleven shillings, which was paid under protest.— The Bench thought nine shillings only should have been demanded ; and as the charge was excessive fined defendant 10s and costs. Threatening Language.— Donald Brown was charged bv John Macandrew with threatening to stab him, on February 1, whereby he was in fear he would do him. bodily harm. Comp'ainant therefore asked that defendant be bound over to keep the peace. •Mr Stewart defended.—lt appealed that high words bad keen need on both sides, and the Bench found that each patty was equally to blame, and dismissed the case.
