RESIDENT MAGISTRATE’S COURT.
Wednesday, January 26. (Before J. Bathgate, Esq., R.M.) M‘Geor:e v. M'Dermid.—Claim L 8 2s lid, short delivery of timber. His Worship gave judgment in this case for plaintiff for L 4 10s 7d ; each party to pay his own costs. Walsh v. Smith.—Plaint to recover possession of a piece of land held by plaintiff under lease from the Sui erintendent with he consent of the Corporation, and alleged to be unlawf >lly occupied by defendant. In this case his Worship ordered that possession of the land be given up to plaintiff forthwith, defendant 'o pay cos’s. Rossbotham and another v Fraser. - Claim LIOO, loss and damage sustained through defendant’s refusal to parry a steam-threshing machine from Dunedin to Gisborne in his steamer Jane Douglas.—Tn giving judgment in this ease his Worship said he was not satisfied that a contra t to carry had been proved, although there were cir umstances on each side supporting the views taken by the part es respectively. Plaintiffs would be nonsuited, with costs. [Left sitting.]
