Monday, November 1. (Before J. Bathgate, Esq., R. M.) James Robertson v. Edward de Montalk, teacher, —Claim, L 33 6s Bd, for groceries supplied, extending from March 2 to August 17. Defendant had expressed his willingness to allow judgment to be entered against him.— His Worship (to plaintiff) : Well, I cannot give you judgment. This account includes thirtymur bottles of whiskey; I cannot give judgment for that. If grocer’s will gvo whiskey on credit they cannot recover in this Court - it is contrary to lawjP'Jt have grave doubts whether I can give judgment for the two bottles of port wine and for the ale. A large portion of this account is for drink. I must, however, strike out the whiskey ; thirty-four bottles at 3s 6d is L 5 19s. Take off that sum, and judgment is given for the balance, 1.27 7s Bd. Now, take that as a lesson ; you should never trust anybody for a bottle of whiskey,--Plaintiff ; We take this as a very hard law ; we pay a license to sell.—His Worship : It is not a hard law ; you will get plenty of people to take goods if you give credit. Mattheson v. N. Hart.-Claim, L2, for tire wrongful conversion of a table-lamp. Mr M‘Keay appeared for plaintiff, aud Mr Rlouat for d -fendant.— P aintiff’s case was that the lamp had been left by him with MT.eod, Downes, and Co. to repair. It was afterwards sold with M'Leod’s bankrupt stock, defendant, who was a purchaser of a number of articles, bought the lamp, and when told that plaintiff was the owner Jrefused to deliver it up —Defendant swore that he had offered to sed the lamp to plaintiff for ss.—His Worship said the only doubt, he had was as to the value of the lamp. Judgment was given .for 3th and costs. Judgment was given for plaintiffs in the fol lowing cases, with costs B.iscoe and Co, v Chamberlain, 1.8 Ids lid, goods supplied Isaac Abrams v, Phos. Welsh, LI 16s, goods; supplied. [Left sitting ]
