THE HARBOR BOARD.
The adjourned meeting of the Harbor Board was held this afternoon; present—Messrs G. Turnbull (in the chair), M'Neil, M'Kinnon, Cargill, Tewsley, and Davie, The secretary (Mr Gillies) read a memo, from Captain Thomson, that William Goldie owner of the lighter Don, had plied with his vessel without a license, and had flatly refused to take out a license. It was decided that a letter should be sent to Mr Goldie informin'* him that if he did not take out a license forthwith, proceedings would be taken against him The Board’s solicitor, writing on the liability of piloting vessels, said that a pilot was no more exempt than anyone else when negligence was shown ; and that the master or owner was free from liabilities if a collison occurred through such negligence. It was stated that m face of this and Mr Stout’s opinion that thfe Magistrate could come to no other decision than he had m Guthrie v. Pilot iVon Pant Ihomson still maintained that the ahm nnri not the lighter was to blame, Mr clhgTll suggested that, in all Concerning nautical matters, the presiding magistrate should have the assistance _ of a nautical assessor. fhfi having advised that the Boaid could not be held responsible for the pilot s action, Mr M ‘Neill considered that in this instance, at least, the Board should relieve the pilot from any costs incurred in the action. discussion it was resolved, “That the question of liquidation of the fine against Capt. dela y e< ! Thomson and Mr A. Mlvmnon report to the Board on the whole circumstances of the case.” The following resolution, proposed by Mr Car- . r 1 is of opinion that in cases coming before Magistrates’ Courts involving nautical questions m connection with shipping in the harbor it would be an important and desirable aid to satisfactory decisions that the Magistrate should have tho assistance of a qualified nautical assessor with whom to consult on technical nautical points.
