CITY POLICE COURT.
Tuesday, August IT.
(Before H. Bastings and J. Black, Esq.’s J.F.’s.)
DRUNKENNESS.— EIIen Burton, a confirmed drunkard, was committed to gaol for three months, having been thrice committed during the preceding twelve months. James Flaherty, Chas. Smith, Henry M'Connell, and John Wyatt, sbarged with drunkenness at Blueskin, were each fined 10s, with the alternative of twenty-four hours’ imprisonment. Samuel Gill, apprehended in Stafford street, was mulcted in a similar penalty. Vaoranct. Emma Lane, charged with having no lawful means of support, promised to leave the town if allowed an opportunity. She w#« therefore dismissed with a caution.
Petty Theft. —Mary Tighe, a decently dressed girl, who gave her age as sixteen, was •barged with having, en the 18th June, stolen a pair of boots the value of LI, from the shop of Joseph Samuels, Manse street. —Prosecutor identified the boots produced, which were taken fiom his shop door on the 18th June, and informed the police of the theft.—Ben. Cuiss, manager in the pawnshop of Mrs Davis, remembered prisoner bringing the boots to him and pawning them in the name of Brown, at the same time stating that she resided at the Ocean Beach.—lnspector Mallard informed the Bench that accused had recently been in service. but was at present living with her stepmother. She did not bear a good character, and had behaved very badly to a gentleman who had taken an interest in her, and given her employment.—Mr Bastings thought it a pity to commit her to gaol, where there was no classification of prisoners, and would, therefore, remand her for a week to see what steps could be taken. Assault and Attempted Robbery.— Patrick Sheedy and Daniel Bairy were charged •n suspicion, on the information of Constable Bain, with having, on the 16th inst., stolen from the person of John M‘Leod a silver watch and chain. —Mr Aldrigey defended. M argaret Millar stated that prisoners called at her house with John M'Leed, in' Walker street, about midnight. Barry remarked to the other one—“ That is a nice suver ‘swinger’ he (prosecutor) has on, and we will have it.” M‘Leod was very drunk, and had occasion to go outside. Barry followed, and taking hold of it pulled itjhalf-way over his head, but witness interfered. Shortly after he made a second attempt, but witness’s husband stopped him,— Both accused were discharged. Dbt Goods Act. —F. Meenan, general dealer, was proceeded against by Revenue Officer Lumb for having, on the 6th inst., kept a greater quantity of dangerous matter on his premises than the law allowed. Mr Aldridge defended.- Kerosene found in defendant’s premises proved, on analysis, to be petroleum.— John Paterson and Richard Comp were charged with having petroleum on their premises in excess of the terms of the Act. Mr Brent defended Paterson, and called the attention of the Bench to a case Heard 1 against Mr R. B. Martin some years ago, in which the Supreme Court decided that the Provincial Ordinance was invalid, and a point was raised as to its inflammatory nature, since which time storekeepers had kept kerosene on their premises.—The Bench were disposed to dismiss the whole of the cases on the legal grounds raised, and they further did not think that tradesmen should be responsible; while it was clearly the duty of the Legi Jature to prevent dangerous commodities su<P as those in question from being brought into the market at all. The revenue-officer was to be commended for hia action.
