DISTRICT COURT.
Tuesday, June 22. (Before His Honor Judge Bathgate.) In the case of Kennedy v. Chapman judg meat was delivered to-day. It was an action to recover the value of certain improvements made by the plaintiff as tenant of land belonging to the defendant. For-the defence objection was made under sections 12 and 4 of the Statute of Frauds, but his Honor decided first that notice of such special defence should have been given; and second, that if jfc had been admissible it could not, in the circumstances of the case, have been sustained. His Honor further decided that LU2 13s 9d was due to the plaintiff, and gave judgment in his favor for that amount, together with costs, but without prejudice to any claim the defendant might have against him for arrears of rent.
