RESIDENT MAGISTRATE’S COURT.

. ram oases. Simpson.—This case, in which plaintiff claims the value of a horse which he affirms to be hisi property, though it has been for some time in defendant’s possession, has been several times before the Court. The horse in question was nowprodneed at the Court door, and was examined^by the Magistrate and by the counsel engaged in the case. Mr Stout again appeared for plaintiff; Mr Harris for defendant.—-Plain-tiff gave evidence as to the identity of the animal—speaking to the general appearance of it, the brand, and various marks upon it—and said that he fully believed it was the one which strayed from his paddeck in March, 1871. The herse was foaled on September, 1870, and would therefore be now rising six years of age. Witness examined its mouth when he first saw it in defendant’s possession and again ten days ago, and there was a difference in its teeth, as u they had been tampered with. One tooth had been broken, one of the tusks appeared blunted, and the black mark on the teeth was fainter. In cross-examination witness said he never heard of a horse’s mouth being altered to make it look older till now, but the effect of .what had been done to this horse’s month was to make it appear older. When the colt was in witness’s paddock it got both pasterns cut by a wire fence, and witness wished to have the hair clipped off these parts to see if the marks of these cuts were ■to bo fonnd. [The Court here adjourned for an hour to enable his Worship to # attend the Governor’s levbe, during which time the horse was to be clipped. After the adjournment and another inspection of the horse, now clipped, the case was continued.] — Frederick Warn, owner of the horse before it was tinned out in plaintiffs paddock, said he branded the horse, which was the one at the Court door, himself, and remembered that he bad done rather low down on the near shoulder. Witness was examined at considerable length as to the brand, both parties to the action haying produced a brand (R) but slightly differing in shape. [After the examination ef eight more witnesses the case was further adjourned till Thursday.]
