DISTRICT COURT.
Monday. January 25. (Before his Honor Judge Bathgate.) Carnck v PyUe.—This case had been adjourned from the last monthly sitting of the i 'ourt, on a nonsuit point, under the Statute of Frauds, raised by counsel for the defendant (Mr Haggitt), and bis Worship now said that he was not prepared to'auslaih the defence on that point.—The case was further adjourned for a month. William Dryden v. Alexander M‘Donald.— Plaintiff, a blacksmith, seventeen years of age, sought to recover from defendant, a livery-stable-keeper, L2O, for that he, on November 22, assaulted and beat plaintiff, whereby the latter became sick, to his loss and damage to the amount claimed,—Mr M'Keay appeared for plaintiff, and Mr A. Bathgate ior defendant. The evidence snowed chat plain' iff and another youiu; man had engaged a tran and horses, the property of the defendant, and the whole not being returned to the satisfaction of defendant some words ensued, and hj - struck plaintiff Judgment was given for 1.2, an costs. Jenkins v. Gawn was adjourned to Febniary 8.
