(Before J, Bathgate, Egq,, R.M.) Monday, January 18. Drunkenness.— George Gallandors, Edward Adams, and Francis Shaw were let off with a caution. Va rangy.— James Cunnack, forsolicitir g alms from Mr Charles Flextnan in Princes street, was sent to gaol for thirty days, emu CASES. Proctor v. Avery —Claim L 4 for money overpaid to defendant on a contract for breaking stones—Plaintiff and his partnei (Whittaker) prpduoed $ receipt for the pav ment in full for the .contract. TRy stated that they had previously given defendant L 4 on account, bpt in settling up with him forgot to deduct the money eLndant swor. most positively that ho had never received the L 4 —his Worship said that there war the oath of plaintiff and his partner against that of defendant, and he saw no reason to discredit the former.—Judgment was given for plaintiff for the amount claimed, with costs.
Meiklcjohn v. M'ConuelL—Claim L2 for wages due, and 15s for board,—Mr Stout appeared for defendant, for whom judgment was given with costs.
