M‘Nar, senr., v. M. H. Baines and F Meenau.—Claim LfiO, for wrongful detention of an entire horse named He iouiu, and for costs and expenses incurred in seeking to recover possession of the said horse Mr M‘Kay appeared for plaintiff Mr Harris for di fendant Thomas M Kay, sent , plaintiff, said he sgave hi* son 1 40 to purcha-e Hedoum, but he did not give wim as the receipt foi the horse when he brought it to his plaor. Witness told him to take the horse to town to fetch his ow i up. Cross ox indued : li del not occur to witness to ask i.is sou what he gave for the horse. He purchased it in August 17, from K. Brown, of Dunedin. - I'h mas ' I Kay. jnnr., son of plaintiff, said he bought the horse of Brown for his father, eiving Lls and another horse for it. Bedouin was worth i 150 then to anyone to travel the season, but not to hack. It waonce sold for 1 27, but that was at an out-of-tho way pi me, Bacon’s yard, aud there weie not many people at the sale. Witnes* wa cross-' xamined at considerable length, and the case had not concluded w.um our reporter left.
