RESIDENT MAGISTRATE’S COURT.
Friday, November 27. (Before J. Bathgate, Esq., R.M.) Drunkenness. —David Forsyth, charged with this offence, and not appearing, forfeited his bail. Catherine Gibbins was fined 20s, or three days ; and Hannah Kelly, an “ Asiatic,” 40s, or fourteen days. CIVIL CASE Arming v. Martin.—This case was continued, plaintiff's tx.mination by Mr Barton being resume ! as follows :—The exact words used by defendant oa his handing me back the ticket were : “ Put it in your pocket; you’ll want it whcnyoi go on board.” He did not say anything about my having to pay my passage money over again. I told him I thought my expenses would cease on arrival here, as the ship would be ready to receive us, to which he replied that if the weather had been suitable, the ship would have been discharged and got ready, when defendant would have had to keep the ship waiting for us. He said M Tlroy should not have told me such would bo the case. I paid M ‘Hr y L 5 on account of a passage in the ship Ev peculador, and as she was taken off, M Tlroy said he would obtain me a passage in the Comet. [Mr Haggitt objected to witness giving as evidence any conversation he might have had with MTlroy, as the latter had not been proved to he the agent of Mr Martin more especially with regard to MTlroy’s arrangements for the Fspeculador. His Worship, after a lengthy discussion between counsel, decided to hear the conversation, but to take a note of the objection.] The Customs authorities would not allow the Especulador to sail, as she was not sufficiently lofty between decks. On arrival at Part Chalmers we went a'ongside the Comet, and after a few minutes went on board her. The captain was on deck at the time, and said the vessel was not ready, but that he would go up to Mr Martin and tell him we, had come. When I saw Mr Martin, he said he had authorised I>l Tlroy to get passengers, but that unless the money was forthcom ng he woqld not take them, defendant did not tell ipe next day that he repudiated the tickets, but t\yp 'fays afterwards.
