Captain Tilly and Gibson.—Plaintiffs in this case sought to recover from defendants, master and second officer of the immigrant ship Invercargill, L 22 lOj, loss to plaintiffs’ luggage through defendants’ carelessness M r Mouat appeared for p'aintiffs, and Mr Haggitt defended.—Plaintiffs, with others emigrating to New Zealand, were conveyed on board the Invercargill, together with their luggage, while lying off Greenock, by steamer on July 21. One of those intending to emigrate was refused admission on boaad the ship, as he had no passage ticket, and the mate ask“d him if plaintiffs’ luggage belonged to him. He replied in the affirmative, and the luggage was placed on the steam j-, plaintiffs’ protesting but without avail. They thus lost their luggage, which consisted of one double feathered bed, of the value of LlO ; two single do, L 5 each ; three pairs of shoes, 15s ; fourteen volumes books. 10s ; and one writing desk, ss.—Judgment was given for LI6 10s, with costs.
