WASTE LAND BOARD.
The weekly meeting of the Board was held this morning ; present—The Chief Commissioner, Messrs Butterworth, Clark, .Reid, and Strode.
Mr Dairy mole, for Mr John Bruce, applied for a fourteen years’ lease of section 28, blocks, Otakia.'for fir..ziiig purposes, -Referred to the Ranger fi jr report. Mr Charles Henderson applied to purchase section 61, block 3, Tuapeka < aat. Approved. r
Mr Doughty, for Mr ■ lexander Dodds, applied to purchase North Harbour aud Blu skin, Withdrawn from sale ; the consent of the Superiutendt nt to bo obtained
Mr Council submitted plans of Mr J. F. Kicchiug’s application for a sawmill lease in Glenkeuich, and asked that the lease be extended to Dec. 31, 1877. Hanger Hughau reported that there were already four mills in the district, sufficient for the wants. Granted, ©n approval of survey, lease to end in 1876.
Mr ’’Connell, for Messrs J. and \V. S. M*Farlan n , submitted plans of their application for a sawmill le $3, aUotm'eut 13, Cilenkph ch, the lease to terminate on December 31, 1877- HJan of mill site was also submitted. The plans were approved, but the extension of the lease a year was refused. unholder’s consent to mill site to be ob taincd.
Mr Connell, for Messrs Herbert, Howat, an„d Co., asked the Board to dispense with survey of their application for a bush lease, block 14, Glenkeuich, as the ground is rectangular, and survey is therefore unnecessary, itefusid ; the survey must be executed. In Mr J. F. Herbert’s application to have the lease of run 212 a auifnded, Mr Connell said he would stake his reputation as a surveyor, and one who knew a good deal about tins part of the country, that there were errors iu the original survey of the run. Consequently what had been an old grievance between Mr Herbert and Mr Eobsrts was desired to be settled—The question had been referred to the Provincial Solicitor, whose opinion was now read to the Board, to the effect that the latter had power to interfere in the matter, but that w probably lead to litigation, unless the Board acted as arbitrators, both parties submitting the question to them.—Mr Connell was of opinion that the Board had no discretion whatever iu the matter, but must aot ip and hear the case. Applicant had the right to come before the Board, and if the Board refused to deal with it he could $0 nwbwe else, Tfeepy jpight tfcli Jjito to
go to the Sn preme Court, but that Court would cniy again refer him-to the Hoard. [Part of c ecision of Judge Chapman, cx parte Bell, quoted, to that effect.] He would a-k the board to carefully consider for itself whether it had or bad not the powers necessary to cfeal with the question, and thought that if in doubt it should not be submitted to the I l ovmcial Solicitor. The’Waste Lands Aob knew nothing of a Provincial Solicitor, but provided that cases should be submitted to a Judge of the Supreme Court. At a former meeting Mr Reid had remarked that the Board might as well be called upon to adiu- ■! mate in such a case at the Taieri or any other plain ; but Mr 'onuell did not .-ee the relevancy, as the land there was private property. -The Chief Commissioner thought the Board could not interfere in this private rquabble. The part es had obtained their rights under the laws of the re-dm.—Mr Reid sdd it was rather hard that Mr Conned should complain of the Provincial Solicitor, siuce that gentleman’s opinion was against him, when he was a consenting party o the question being nferred there.—Mr ir »de said even if the Board interfered it would not advance the matter one jot, as the losing person would immediately go to the ■upreme Court—lt w.s resolved that the Board cofcsider it inadvisable, under all the circumstances and keeing in view the opinion of the Provincial Solicitor, to interfere in the matter, leaving the parties to their remedy at law;
Mr Harris, for Messrs Begg, Shedden, and Siucl-dr, applied for a sawmill lease of 160 acres near Mr Pollock's lease at Gienoatnatu, Fosop ued.
Mr Charles Barnett applied for a jetty site opposite section 28 bock 20, Shotover. Ref rred to the District Laud Officer for advice. Mr James Reid asked permission to fence m the reserve, section 30, block 4, Wyndham, he leaving gateways. To bs licensed und- r d mse 161, at LI per acre. Messrs Fitzpatrick and Co asked rcconstderation of their application for authority to sell the timber growing on their mining claim, and ottered 10s per annum for the rv-ht.
