Wednesday, October 21, (Before his Honor Mr Justice Chapman and a Special Jury.) N orth v. VowELE —This was an action brought by plaintiff member of the firm of North and -'coullar, to recover L2oodamage* from defendant, captain of the ship Undine, for less sustained by the defendant’s negligence, whereby a case of mirror glass became injured and the contents rendered useless. Messrs Macassey and Haegitt appeared for pla ntiff, Messrs Smith and .-stout for defendant. The declaration set forth that plaintiff’s agentsm London (Messrs Shaw, Saville, and Co ) shipped the case of glass in good condition, obtaining a receipt to that effect; but that defendant negligently lowered the goods into the vessel’s hold, the result being that the case slipped and fell, smashing the contents. Messrs Campbell (of Calvert and Campbell), Nortu, id. &. Fish, jun., and Captain Hardy gave evidence during the day, Mi Fish being under cross-examination when we went to press. *<■
