RESIDENT MAGISTRATE’S COURT.
Wednesday, July 8. (Before J. Bathgate, Esq., R.M.)
The Magistrate took his seat on the Bench at twenty minutes to eleven.
Drunkenness —John M'Luakey was fined 10s, with the option of three days’ imprisonment ; John Hotson, not appearing, had his bail (40s) forfeited; George Maddison 10s, or Ihree days’ imprisonment; Elizabeth Rose was discharged.
Theft. —Ah Long was charged by James Patterson, hotel keeper, with stealing, on the 7th July, from his premises, six yards of calico of the value of 6s,—Prosecutor said that prisoner had been in his employ for some weeks past. He left yesterday, and witness, missing some calico, followed him and overtook him in the Arcade. He found the caiico in prisoner’s swag. Prisoner admitted having taken it, and behaved most straightforwardly. —Sub-Inspeetor Mallard intimated that, under the circumstances, he would not call any more witnesses.—Prisoner, by the interpreter, said that he did not take the calico with any felonious intent. He complained of the cold, and Mrs Patterson told him that he might take the calico in the mean time, and he understood that he might take it altogether.—Prisoner was sentenced to fourteen days’ imprisonment. Assault on a Police Constable. —John Hall was charged with assaulting Constable Henderson, while in the execution' of his duty, on July 7.—Sub-Inspector Mallard pointed out that the assault was not a very violent one, and was brought principally to uphold the rights of the police.—Constable Henderson said that while on duty in the Princess Theatre, on Saturday night, his attention was called to a disturbance in the pit by some persons shouting “Turn him out,” and beckoning for witness. He went over to the prisoner, and cautioned him not to commit a breach of the peace, or ho would be put in the lock-up. Prisoner then used very foul language to him, and followed him into the passage leading from High street into Stafford street, and there, in the presence of about a hundred people, caught hold of him by the jumper and pinched his legs. Witness thereupon arrested him.— Prisoner said that the prisoner “ collared” him by the back of the neck in the theatre. —His Worship: If you were assaulting any person he was at liberty to do so,— his Worship said that prisoner had been misconducting himself in the Theatre, and the proprietors were justified in ejecting him, using no more violence than was necessary .in doing so. If they required the assistance of the policeman, they were at liberty to call upon him. He was fined 20s or eight days’ imprisonment.—A second charge, of using profane and obscene lanwithin the hearing of persons passing in High street, was dismisssed, there being no witnesses who heard the language' used in the street.
