SEEING that I and my fellow-passengers are likely to become seriously injured m the estimation of the public, especially, very probably, in the eyes of such of them as may compose a jury at a subsequent period, from what 1 conceive must have oeen an unintentional mis-statement of what, at all events, was not in evidence, nor a matter of inference, nor was it by any means a fact, namely, that the passengers had ‘‘abandoned their luggage’’-upon which abandonment (for this word occurs not less than five or six times in the very long judg meat) Mr Bathgate seems evidently to have based his judgment -I deshe that the public should be undeceived in this particular, not only by their being thus informed, but also informed that, so far from our having abandoned or ever intended or thought of abandoning our luggage, we, on the contrary, did all we could to get our luggage, by returning to Catlin’s River for the very purpose, but could not procure a boat; and does our hav mg protested against the sale of our luggage (which, notwithstanding, was not excepted from the sale, but sold on the sale of the whole contents of the ship) show that we, on the contrary, meant to “abandon” it? Had we so abandoned, then we would have had no right of action. Our taking legal proceedings would have been absurd, if to recover that which had been abandoned, in which we then could not have had any interest to recover. This speaks for itself. The judgment is thus based, without evideuce, on an assumption which is unsupported—nay, contradicted-by the evidence, for we never abandoned our luggage—uuite the contrary. f lease insert this, and oblige JOHS OUTRED.
