BETTING TRANSACTIONS.
Mr Justice Fellows, ©neof the ablest lawyers Victoria possesses, has decided, in a case tried before him, that betting “ is perfectly legal ” and judgment was recorded in favor of the plaintiff in a case where he sued to recover the amount of a cheque which had been given as the amount of a loss incurred in making a bet. The law, as we understand it, is this :—lf Smith makes a bet with Jones, and loses, Jones cannot .recover in law from Smith ; but should Smith give Jones a cheque, and subsequently repent having done so, Smith cannot legally dishonor the chequ© should Jones have paid it away to Robinson. But then it must be shown that Robinson did not know, when he received or cashed the cheque, that it had been given in liquidation of a-,betting transaction. As there have been many disputes in Auckland as to the right to recover upon wagers, the above will show how the law stands, A canuot recover from B for a lost bet ; but if a third party, C, is introduced, under the circumstances hero stated C can recover from B. ’
