Bathgate apS eared in support of the application.—Hia [onor said it appeared from the Trustee’s report that bankrupt had settled property on hia wife while he was in a state of insolvency ; also that he hid remitted a surd of L2OO to his brother at the time of being served with a writ; and that he had some peculiar transactions with Melbourne firms. He had also kept no- books, and had caused the' Trnateo mnchrtrouble in getting information as to his affairs.—Mr Bathgate said bankrupt was an illiterate man.—His Honor remarked that though the non-keeping *of books was a ground for witholding a discharge, still he never enforced it: against illiterate men. However, looking at the ciroßmstances of this, case;' he should suspend bankrupt’s final discharge for twelve months; —Re John Dempsey, John Perry, William Shields Kerr, and Michael Fleming, for all of whom Mr M'Eeay appeared, final discharges were granted. ' In. the last-named case (that of Micha'el.Fleming) his Honor said that he agreed with the Trustee’s report, which said that bankrupt’s conduct had'been objectionable, in, sacrificing his stock for L 135, when it was estimated to be worth L2OO more. This had reduced him to a state of insolvency, and; though 1 ' scarcely amounting to recklessness, such behaviodr waa highly cultisble and deseWing of ceiisurC. ; ‘The Trustee however, acquitted bankrupt. ®f fraudulent intentions^- —Re Samuel Philp and John Philp: On the application of Mir B.
