RESIDENT MAGISTRATE’S COURT.
Monday, February 23. (Before A. C. Strode, Esq., E.M.) P^ UNKE!yTNESS - —Charles Crawford and Michael Moloney were fined 5s each, or 24 hours’; James Mahone, 10s or 48 hours’. CIVIL CASES. Forster v. Archer.-Claim LIS Bs, for board and lodging. Judgment for amount claimed, with costs. Fogo v. Moull.—Claim LI2 7s 6d, balance of account for work and labor done and material supplied. Mr Harris appeared for plamtaff, Mr Johnstone for defendant. —Plainunstated that the claim was for painting, papering, &c., done by him for defendant ami a man named Waites who were partners, but the latter of whom was now away. Crossexamined : All the money that he had received on account of the job was paid by Waites, who also gave him the instructions for the work.—David Blackie, salesman to Messrs Guthrie and Asher, said that defendant aad Waites went together sometimes to buy timber of his employers. Witness, I however, could not positively remember defendant saying anything at such times that would shew be was in partnership with Waites.—Defendant stated that in the job in question he was not in partnership with Waites : he merely received 10s a day from the latter while the jab lasted.—tyilliam Woodland stated that ia the course qt conversation with plaintiff the latter had stated that Waites had gone away, and that he could not look to defendant for the money: Witness had never heard anything tq lead him to think the two were partners Worship thought defendant had lead plaintiff to believe be was a partner with Waites. Judgment wquld be given for plaintiff for amount claimed, with costs. Judgment was given by default in the following cases Janet Ferrier v. George Mnstone, claim I6s 9d, for groceries supplied; Watson and Martin v. James Cam stjck, claim L 3 s*, (or coal supplied. "
