RESIDENT MAGISTRATE’S COURT PORT CHALMERS.
Tuesday, February 10. (Before Drs. Drysdalo and O’Donoghue. J.P.’b) Ship Desertion.— Andrew Jackson was charged by Captain Peregoy with being absent from the barque Cesarewitch, without leave, on the 9th inst. Mr Mansford, for the prisoner, pleaded not guilty, and stated, before the case was heard, that he wished to lay an information against Captain Peregoy for assaulting the prisoner. The prisoner had only left the ship for the purpose of seeing a policeman, on account of being struck by the captain, when the latter gave him in charge, Mr Mansford was prepared to go on with the case at once if the captain would allow the first and second officers to come on shore, as he required them as witnesses.— Capt. Peregoy declined to allow them to come on shore, as the vessel was ready for sea and would have sailed last night only for this case.—Mr Mansford then asked for an adjournment, which, being granted, Captain Peregoy became willin'* to fetch the officers. ° (Before Captain Thomson and Dr Drvsdale. J.P.V) The charges—Andrew Jackson v. Captain Peregoy, and Captain Peregoy v. Andrew Jackson—were both dismissed, with costs.
