RESIDENT MAGISTRATE’S COURT.
Wednesday, February 4. (Before A. C. Strode, Esq., R.M.) CIVIL CASES. Christian v. Parker and Parker v. Chris tian.— hlis Worship, in delivering judgment in these cases heard on Monday last, said from all he could gather he was of opinion that the claim Christian v. Parker was substantiated with the exception of tht items for washing and mending Judgment would, therefore, be for the plaintiff in tht sum of Ll3 15s.—In the cress action judgment was given tor the defendant.—Mr Barton elected to cake a nonsuit, which was granted.
Judgment was given by default in the fob lowing cases :-Watson v. Statham, JL3 8 Id, for groceries supplied; and Isaacs and Marks v. Statham, Ll 10s, for clothing supplied. Legal Service of Summons. —On the case Moore v. Sandison being called on, Mr Harris, for the defendant, asked for an adjournment as the summons had not been served forty-eight hours prior to the time of nearing.—Mr Stewart, who appeared on the other aide, said he had frequently from the same cause found it necessary at great expense to have cases adjourned. In this cas;; the plaintiff and three witnesses were in attendance at considerable expense to themselves. Up to that time be did not know that the summons had not been served within the requisite time. It was issued on the 29th ult, and therefore plenty of time had been allowed.—Mr Strode did not know the circumstances of the case. Sometimes the defendant could not be found.—Mr Stewart : Then the summons should not have been served by the bailiff, and the date could have been altered.—Mr Strode thought that was the proper course to pursue.—The bailiff seated that defendant tried to get away from him.—Mr Strode said that when he found he could not serve the summons within the requisite time he should not serve it at all. It was quite necessary that it be served fortyeight hours prior to the time ef hearing.— The case was then adjourned, by consent, for a week.
