(Before Dra, Drysdale and O’Doaoghue J.P.s) b Sly frßoa Selling.—Robert Kirk was charged upon the information of Sergeant Neil with having, on December 17, at Hothsay, sold one panmkiu of ale to Peter Ganican, he not being licensed. Mr Mansford, for the defendant, pleaded not guilty.Sergeant l eil stated that the case woul * have been brou.ht before the Court soener f ut that the defendant could not be found* so that the summons might be served upon biro.—Peter Ganican said he was a laborer and knew tbodefeudant, who lives about one mile from Burke’s Brewery. Witness had been working on the road for some time previous to paying the defendant bn the 20th of Oec*|aber 10s forbeer supplied to him during that took; he IkVwiw paid the defendant

He could not remember hj ij? long ago it was when he trot the beer, but thought it was a fortnight last hursday Mr Mans'ord raised two objections —first, that though the law did nut require the precise day U| on which the offence was committed to be named, it required that it be “tatcd to have occurred between two stated days ; second, that the Liceusing Act of 18155 states that no one shall be allowed to sell liquor only und r that Act, while the Licens ng >ctof the (.General Assembly, 1873, clause 31, repeals any Act previously made. —Sergeant I'eil stated to the Bench that convictions were obtained in Dunedin last week under the earn > Act. - The Bench retired f'.-r a short time, and, upon returning into Court, stated they considered the information was good, and they had power under the Ordinance. They fined the defendant L2O and costs. Mr Mansford gave notice of appeal.
