Mr .barton, with him Messrs Haggitt and C, Cook, for the plaintiffs, John and Taylor White; Mr James .Smith, with him Mr Chapman and Mr Branson, for the defendants, David Peter and Thomas M'Kellar. The following comprised the jury Messrs C. Burke (foreman), Callendar, Blackadder, Jago, J. K, Jones, Law, J. Mitchell, S. Clayton, Ball, Hnnn, Park, and Black, 'ppg declaration contains seven counts, T/hich alleged that on the 4th and’ sth August 1806, and divers other days, the defendants trespassed upon the plaintiffs’ property, known j>. B tiui No. J34 ; that they expelled ttye sheep, took possession of their nuts, shearing ground, &c„, and occasioned the plaintiffs other loss a#d damage; that they had agreed to submit the disputes between the parties to arbitration; that an arbitration took place and an award was given in favor of the plaintiffs ; hut that defendants had refused to carry it out, wherefore additional damages were claimed —or in all LJO,ODO, Mr Barton’s address to the jury occupied nearly the whole of the day ; but, ovying to the pressure on our space, we arc obliged to hold over our report of it.
