Wednesday, October 15. (Before I. N. Watt, Esq., 11.M.) rOLIf'B CASES. Drunkenness. —Alex, C. Webster and George Jones were each fined 5s for this offence. Embezzlement,—The adjourned charge against William Scott for embezzling ss, the property of Messrs A. and T. Inglis, his employers, was withdrawn ; and a fresh information charging him with larceny laid. To this the prisoner pleaded guilty, and wa. sentenced to one mouths’ imprisonment with hard labor. CIVIL CASES. Judgment was given by default in the following cases, with costs Woodley v. Bonn, claim LJ fis for board and residence ; Morecombe v. Potter, LI 12s 7d ; Barron v. Stewart, LG 12s Gd. Schmidt v. Linn. Mr M‘Kcay, who appeared for the defendant, said that plain tilf must be nonsuited, as the J4th section implied that a full and explicit statement iu writing must be given. Now, this baa not been complied with, for the summons state 1: “To bill delivered, JL3 18* lid,” and after-

wards “three and a-half loaves of bread, 2s Id, ” there being no date in either case. ■lr W. W. Wilson, who appeared for plaintiff, declined to be nonsuited. —Mr VDKeay: Then the case must be dismissed. —His Worship said tire case would bo struck out, there not being sufficient evidence.
