RESIDENT MAGISTRATE’S COURT.
Monday, August 20. (Before I. N. Watt, Esq., R.M.)
Gibbs and Clayton v. Goodfellow.—A rehearing in this case, in which judgment was given on the 20th instant, was. applied for by Mr A, Bathgate, counsel for the defendant, on the grounds that material evidence had been discovered since the hearing of the ca-e, and that as the evidence then given was conflicting, perjury must have been committed on one aide or the other. Mr Haggitt opposed the application, contending that the fresh evidence could not affect the judgment given. His Worship took to consider the application, stating that he would give his decision on Wednesday next. Knight v. Corfleld.—Claim L 6, for rent. Defendant admitted liability, but asked time to pay the debt. Judgment for plaintiff for amourrt claimed, with costs, to be paid in one month.
Seager v. Douglas.—Claim L2 ISs, amount of judgment given against the defendant three months since. Defendant pleaded inability to pay the amount before this, but was now willing to pay it by instalments of 5s a week. His Worship gave an order to that effect.
Peyton and Thomson v. Fowler.—Claim L 5 ss, for use of entire. Defendant stated that he bad given no authority, and judg* ment was given for him, with costs. Judgment was given by default in the fol* lowing cases : —New Zealand Distillery Co. r. Webster: claim Ll7 18s 7d, for goods supplied. Elizabeth Hogg v. Fanny Edgar s claim L2 12s 6d, for dressmaking. Bunce v. Atkinson : claim L 4, balance of account for fencing.
