Saturday, August 2. {Before His Worship the Mayor: H. S. Fish, Esq.; and J. Black, Esq., J.P.’s)

Drunkenness, Henry Markham, and James H. O’t Liberty were fined 10s, with the option of forty-eight boms’ imprisonment.—William M‘Donald wa« charged with being drunk, and with assaulting Constable Vernon, while in the execution of his duty on the 31st inst. Evidence was given for the prosecution by Constable Vernon, who stated that on arresting the prisoner he was struck twice and kicked by him ; and by Sergeant Deans, Constables Beasley, and Doran, who stated that accused was under the influence of liquor when in the station. A witness named Smith who had been in accused’s company, said that while they were walking along Princes street south, they were accosted by the constable, and after having a short conversation with him, he said he would lock the accused up, as he had been locked up before. The latter agreed to go quietly, which he did ; and he was not, to the best of witness’s knowledge, under the influence of liquor. He did not see accused strike the constable, and he watched them go about fifty yards. Constable Vernon, recalled by the Bench, said that they were only about four or five yards from the last witness, when he was struck. The night was dark. Accused said that he had subpoenaed another witness, who was not present, and he wished to add that nearly every police sergeant in the force would admit that he had frequently lent them valuable assistance. The Bench considered the evidence on the charge of drunkenness was indisputable, and fined the accused 40s, or in default, forty-eight hours’ imprisonment, and dismissed the other charge, saying that if the assault had been committed, Smith, according to the constable’s evidence, was sufficiently close to observe it. - vVilliam* Lloyd, for being drunk in the Court on Thursday morning, was fined 40s, with the alternative of forty-eight hours’ imprisonment.

Petty Larceny. —Ah Ming, charged with stealing a quantity of zinc, of the value of 6s, the property of .Mills, Dick, and Co., was discharged with a caution. Mr Stout appeared for the accused.
