CITY POLICE COURT.
Friday, June 13. (Before his Worship the Mayor.) Drunkenness, —Henry Berston was fined ss, with the usual alternative. Assault. —John Pearce, lighterman, was charged on information with assaulting and beating Charles Jackson, on the s:h inst. Mr Joyce, for the complainant, stated that on the day in question defendant took some blooks lying on the jetty for the use of any of the lighters requiring them when discharging; and on witness speaking to him about tb.em, lie struck him in the face without the slightest provocation. Complainant then said, “Would you strike me, John, whereupon defendant struck him in the chest. Several witnesses called said the blows were struck by the defendant without the slightest provocation. —Defendant and a witness named William Jenkins said that only one blow was struck, and that was upon complainant assuming a fighting attitude. — Jenkins affirmed such was the case, as he was present during the whole of the time, and that he was in Court as a witness to speak the truth between God and man.—His Worship thought an unjustifiable assault had been committed. Either Jenkins was mistaken in wjjat had occurred, or he was not the witness of truth. Defendant would be fined in the sum of 60s, together with costs of Court, 20s; professional costs, 2ls; and costs of witnesses, 355.
