Sib —ln reply to your correspondent “J. p w I would simply observe that the question should not bo “ Which was right ?” but «is the report right ?” Mr Watt will bear me out that he was recording a judgment for the defendant; but afterwards addressing the solicitor for the plaintiff, said: “ I believe you are right; it must be a nonsuit, as you have had no opportunity of cross-examining defendant’s witnesses.” Defendant’s solicitor acquiesced in this, and the plaintiff was nonsuited with costs.
