RESIDENT MAGISTRATE'S COURT.
This Day. (Before James Fulton, Fsq., R.M.) CIVIL CASES. Dempster v, Millar.—This was a claim for L 53 on a contract, and for extras done in connection therewith. Mr I). Stewart appeared for plain'iff, and Mr Han is for defendant. Dofcndan' paid LT2 19> into Court, and pleaded a set-off of Lls for non-fulfilment of contract, and 1/25 Is for loss and inconvenience occasioned thereby, and extra charges. Judgment for the amount paid into Court, together with costs, A. R. Mackay v. Job Wain.—This was a case under the Resident Magistrate’s Evidence Act, to take evidence having reference to a charge of negligent driving on a public road on the 29th March last. It was alleged that the defendant, while driving a coach on the date mentioned, displayed such wilful and negligent driving that the plaintiff sustained damages to person and vehicle, whereby he now sought to recover the sum of LSO. The evidence of two witnesses was taken, and the case was adjourned until the 2nd proximo. Mr Harris appeared for the plaintiff, and Mr Chapman for defendant.
