RESIDENT MAGISTRATE'S COURT.
Tins Day. (Before James Fulton, Esq., R.M.) CIVIL CASES. Massey (Town Clerk) v. Harkness.—L23, three months’ rent of South Dunedin weighbridge. Judgment by default for amount claimed, with costs. Slessinger v. Main.—ln this case, plaintiff claimed L 25, for services alleged to have been rendered to defendant’s horse by plaintiff, in the capacity of veterinary surgeon, and for medicines supplied.—Mr Stout for plaintiff and Mr. Turton for defendant.— Judgment for plaintiff—Lls and costs. George Adams v. Hugh Ross. —Plaintiff sought to recover LIOO for personal injuries alleged to have been caused by the negligent driving of defendant, while in charge of a coach, between Anderson’s Bay and Dunedin. It was set forth that early on the morning of the 9th of November last, defendant left Anderson’s Bay with a coach licensed to carry 20 passengers, but carrying 23 adults and one child. Immediately after starting, defendant began to drive the horses at a rapid pace, and w r hile passing round the corner, the coach was upset, and fell on plaintiff, who at the time was an outside passenger. Plaintiff sustained a fracture of the left foot and internal injuries, from which he was still suffering. He had since been unable to earn a living, Mr Barton appeared for plaintiff, and Mr Stout for defendant.—Defendant pleaded that he was in no way responsible for the accident Mrs Adams, wife of plaintiff, stated that at the time the accident occurred defendant was driving at such a rapid pace that she could not observe the revolutions of the wheels. There were 22 passengers and a child on the coach at the time, including plaintiff. After the accident she said to defendant, “See what you have done;” and he replied that one of the w heels was defective. She did not pay a fare to defendant. —Andrew Watson said hj i was sitting on the front of the coach at the time of the accident. Defendant, he thought, was driving too fast while going round the turn. (Left sitting.)
