RESIDENT MAGISTRATE’S COURT.
This Day. (Before A. C. Strode, Esq., R.M.) Civil Cases. Elliott v. F. R. Soraraerville.—Claim, LI 18s 6d, for board and lodging. Mr Harris for the plaintiff. Judgment, by default, for plaintiff for the amount. Mitchell v. Kelly.—L2 16s, a claim for wages. Mr Stout for the plaintiff; Mr Mansford for the defendant. According to the evidence of the plaintiff, she was engaged to go to the Heads by Kelly’s brother, at the rate of 12s a week. She was there live weeks aud three days, when she asked leave to see her mother, promising to be back the next day at three o’clock, but, having a bad cold, she sent a letter saying she should not return. On applying for her wages no answer was sent. In cross-examination, the plaintiff stated that Mrs Kelly, on being asked to allow the plaintiff to go to see her mother, said it was very inconvenient, as she had twins that required looking after. For the defence, it was stated there was no weekly hiring, but that the arrangement was that the plaintiff should stay six months, or give a mouth’s notice if dissatisfied. The plaintiff was recalled and denied this. The defendant’s wife said, at the end of three weeks an arrangement was made that a month’s notice should be given on either side. Mary Ryan was called, who corroborated the defendant’s statement. His Worship considered the hiring weekly. He had no doubt the plaintiff had behaved badly, but there was no means of punishing her except sacrificing the three days. Jugment for the plaintiff, L2 10s, without costs. Gibbs and Clayton v. Forrester.—Mr Stout, for the defendant, stated that he had signed a declaration of insolvency, which was duly gazetted. The case was dismissed.
