The defendant paid 14a 7d into Court, and pleaded not indebted as to the remainder. Judgment for plaintiff, LI, with costa. J. Morris v. T. Jackman. —L2 If s, balance of account for ground rent. Judgment for plaintiff, LI Is, with costs. Geddes and Willis v. J. P. Hydes was a claim for Ll6, moneys advanced, which defendant, while admitting, said should be reduced by the value of some property of his retained by plaintiffs.—His Worship said that question could not he entertained, as no set-off had been put in. Defendant; That’s the trouble; the only trouble I hare at the present moment. If I could have paid I should not have been hero this morning, for I want to get out of tho clutches of these men, I can assure you. I wilt pay 10s a week. Mr Stout, who appeared for the plaintiffs, said his clients would accept that sum if its payment were guaranteed. The defendant was not a resident in Dunedin.—Defendant : I reside in Mosgiel to-morrow.—His Worship ; And somewhere else the next night ? -Defendant : At Tokomairiro, your Worship. But I am not going out of the Province that lam aware of.—His Worship asked defendant if he could offer any security ; and Mr Hydes replied none but his personal security. His profession was a precarious one, and he knew no one in Dunedin ; but if be did, ho would not submit him to such an insult as to ask him to become his security for the payraeut of 10s a week. He said he was unable to employ a lawyer, and asked his Worship’s advice as to how he should act in regard to his “ assets ” retained by the plaintiffs ; but his Worship said it was not his place to give advice. Judgment went for the amount, with costa.
