Orr v. Neill.—ln this case evidence was taken for transmission to Greymouth, where the matter is to be determined. Mr Brent apueared for defendant; M r Holmes watched the case for the plaintiff. Mr Brent was about to call witnesses, when Mr Holmes said he appeared under protest. His Worship : I thought you did not appear. Mr Holmes : I repeat, I appear under protest. His Worship: I know no such appearance. Mr Holmes : I mean to say that on the last last occasion when the case was fixed to come on I appeared for the plaintiff, and no one appeared for the defendant ; and I then objected to an adjournment, and asked that the application of defendant should be dismissed. His Worship : There was nothing before the Court to show that the notice had ever reached the plaintiff. From the affidavit of the bailiff at Greymouth it appeared that the notice had been served on the plaintiff’s solicitor, which was no service. Mr Holmes: Granted ; but the plaintiff should not suffer through any neglect of the bailiff- His Worship : I treated the case as a nullity, and therefore a fresh notice had to bo served on the plaintiff'. The evidence for the defendant was then taken, and was to the effect that the shipment of hams—iu respect of which damages were claimed for them having been sent in bad condition—was made in prime order and condition. Harris v. Hicks.--LI 12s for goods supplied Judgment by default for plaintiff, with costs. Fish v. Jackson.—Lß 3s 4d, dishonored bill, together with interest. Judgment by default for plaintiff,’ with costs. Same v. Norton.—L9 14 9s for goods supplied. Judgment by default for plaintiff, with costs. Goughian v. M'Dermid.—L7 for paddocking bullocks, and for hay and goods supplied,—Judgment by default for plaintiff, with costs.
