RESIDENT MAGISTRATE’S COURT.
Tins Day. (Before I. N. Watt, Esq., R.M.) Civil Cases. M'Lareu v. Stivens—fraud summons. Case adjourned tiff the 6th of next mouth, Strachan v. Darling, Bennett, and Wedderspuoa claim for wages, LIS. Mr Stout for plaintiff; Mr Stewart for defendants. Mr Stout stated the ca K e; that plaintiff was salesman to Bennett and Co., and sued for wages due to him by that firm. Due of the partners (Mr Darling) went out of the concern some eight or nine months ago, and disputed his liability. The law of partnership was that if a partner went out of a lirm without giving notice to his creditors, he was liable. Since Darling went out, a bill of sale had been granted to Darling by Bennett for a debt owed to him.—The plaintiff said lie was a salesman, and had been in the employ of Darling, Bennett, and Co. He never got any notice of Darling retiring from the firm, and did not know of it at all until he saw it in tbe newspapers. In cross-examination, witness stated that he sued Darling because he had all the assets of the estate.—Mr Stewart admitted there was no defence in point of law ; but he wished to explain that it was well known Darling had retired from business. Darling agreed to pay all the debts according to a schedule, but Strahan’s name was nob on that schedule. Judgment for plaintiff, with costs. Thompson v. Macleod—L7, for five quarters’ tuition of defendant’s three children at the North Taieri school. Mr Thompson appeared as plaintiff on behalf of the committee of the above school. Judgment for plaintiff.
