Civil Cases,

Kedzlie v. Dernier.—L9 ISs. Mr Stout for plaintiff, Mr M‘Keay for defendant. For cartage of goods from defendants store, horse hire, and fowls. The plaintiff, in his evidence, said that he took loading thirtytwo times for defendant sixteen weeks. The wife of the plaintiff stated that about twenty men employed _on flax manufacture, who had been supplied with goods by one Paterson, whose business was taken by Dormer, who agreed to pay the same terms of carriage as were formerly paid by Paterson. George Paterson, the former occupier of the store, confirmed the evidence of the plaintiff. Other evidence was given in support of the statements of the plaintiff. For the defence, the contract for carriage was denied. The d( fendant said that no agreement was made for payment, and that not more than twelve trips had been made by plaintiff in which goods had been taken to the flax mill for defendant. He considered the taking of the goods a neighbourly action. The defendant’s brother supported his evidence. His Worship considered that there was a contract for carriage. Tire cost of the fowls, 3s 6d, was paid into Court, and judgment given for LG 5s in addition, with costs.
