RESIDENT MAGISTRATE’S COURT.

This Day. (Before A. C. Strode, Esq., R.M.) A ROW AT ST. KILDA. Jane Allen, wife of William Allen, Anderson’s Bay Road, was charged by John Pugh Jones with assaulting him on the 9th May. —The defendant admitted the assault, but pleaded that the complainant assaulted her first.—Mr Stewart, for the complainant, stated the case, and called the complainant, who detailed the circumstances.—From the evidence of a witness named M‘Donald, and others, it appeared that Jones had engaged M‘Donald to plough his paddock, when Mrs Allen interfered to prevent him, and ordered him off. As Jones persisted, and took hold of a boiler belonging to the lady to remove it off the ground, her ire was roused, and she proceeded to dispute possession of room for the boiler to stand upon. So she pulled and Jones pulled, until growing more angry, she put herself in position and squared at. him. Jones said, “ et out of the way, you cat.” This was too much for the lady, who gave him ‘‘one or two” in the face; then seizing a batten, she belabored his shoulders, and ended by throwing a paling at him. M‘Donald admitted defendant was too much for complainant, but added it must be a very weak woman who was not too much for a man.—-George Harrington, for the defendant, said he was owner of the property, the house on which was burnt down, and the material saved sold. By his permission Allen’s horses were put in the paddock.— His Worship considered the defendant’s conduct most reprehensible, and that complainant had behaved with great forbearance. She was fined L 3 and costs, or, in default, fourteen days’ imprisonment. The Court was adjourned to Saturday.
